Special Judge allow formal arrest of two arrested for alleged link with insurgency

After hearing both the parties and on perusal of the application, the court allowed the NIA to formally arrest the accused persons in the best interest of the investigation.

The Special Judge (NIA), Manipur on Wednesday permitted the National Investigation Agency (NIA) to formally arrest two persons arrested by Bishnupur PS on June 24 for their alleged link with insurgency.

The arrested persons were identified as Bijoy Kakchingtabam, 54, son of (Late) K Achouba Sharma of Khongman West, Imphal East, District and Leimapokpam Shanjitkumar Singh, 41, son of (Late) L Godadhor Singh of Singjamei Oinam Thingel, Imphal West District.

The NIA filed the application under section 41(c), 156, 157 of the CrPC to formally arrest the two.

During the hearing, Special PP of NIA submitted that the two arrested accused persons were in association with one Shakhen, SS Publicity Director of a proscribed terrorist organisation and they came to Bishnupur as per direction of the said Shakhen for recruitment of new cadres for proscribed group from Bishnupur area and send them to Myanmar.

The special PP of NIA mentioned that, in compliance with the government of India, Ministry of Home Affairs (MHA), Order F. No. 11011/59/2022/NIA on July 12, 2022, the National Investigation Agency, Branch Office, Imphal registered a case being FIR No. RC-01/2022/NIA-IMP dated 13.07.2022 under section 18B and 20 of Unlawful Activities (Prevention) Act against FIR No. 26(6)2022 dated 24.06.2022 registered at Bishnupur Police Station, Bishnupur District, Manipur under section 18B and 20 of Unlawful Activities (Prevention) Act. 

Further, pursuant to the court’s order of July 14, the CIO has taken over the case documents, case diaries and material exhibits of FIR No. 26(6)2022 from the OC Bishnupur PS on July 15, the special PP said.

Counsel for the accused had no objection to the application filed by the NIA.

After hearing both the parties and on perusal of the application, the court allowed the NIA to formally arrest the accused persons in the best interest of the investigation.
