Son convicted for murdering father

The Session Judge, Bishnupur, on Wednesday convicted a 47-year-old man for murdering his own father in 2014.

Khangjrakpam Boby Singh, aged about 47 years, son of (L) Kh Sanakhomba @ Samungou Singh of Khoijuman Maning Leikai, Bishnupur district, killed his father Kh Sanakhomba @ Samungou Singh on January 3, 2014.

Upon completion of investigation of the case, a chargesheet was submitted against the accused under section 302 IPC for trial to the Chief Judicial Magistrate, Bishnupur. The case was, thereafter, committed to the court as section 302 IPC is exclusively triable by the court of Session.

The court framed charge u/s 302 IPC against the accused and he was asked whether he pleads guilty or not during which he did not plead guilty and claimed to be tried.

After a long trial of the court, additional public prosecutor submitted that the oral evidence of the prosecution witnesses, along with the exhibited documents and articles, have been able to prove beyond reasonable doubt that the accused has committed an offence punishable u/s 302 IPC.

At the time of hearing, he submitted that there is no eye witness in order to prove the present murder case but submitted further that the prosecution has proved the offence on the basis of the circumstantial evidence as against the accused.

And also, defence counsel submitted that the prosecution has not established prima facie case against the accused. All the links in the chain of circumstances are incomplete. The case in hand, there is no dispute that no eye witness is there and as such to prove the guilt of the accused shall fully base on circumstantial evidence.

However, the court, after hearing all submissions and found all circumstances facts and evidences, opined that it is the nature of injury, the part of body wherein it is caused, the weapon used in causing such injury which are the indicators of the fact whether the respondent caused the death of the deceased with an intention of causing death or not. Hence, it can be gathered the intention of the accused from the injuries found on the death body of Kh Sanakhomba Singh. It falls under section 300(3) of the IPC.

Therefore, the court convicted the accused under section 302 IPC for committing the offence of murder of his own father.
