The Supreme Court on Thursday ordered that Yumkham Erabot Singh shall not be entitled to cast any votes on the floor of the Manipur Legislative Assembly or in any committee of the House and he shall also not be entitled to draw any monetary benefits in respect of the office of member of the Assembly.
Division bench of the apex court comprising Justice UU Lalit, Justice Indira Banerjee and Justice KM Joseph issued the order as an interim directions, following a civil appeal filed before the apex court under section 116A of Representation of People Act, 1951 against Erabot and one another individual.
However, the division bench has permitted Erabot to represent the electorate in the House and to participate in the debates.
Giving four weeks period to Erabot for filing counter affidavit against the petition and three weeks for filing any rejoinder of the petition, the court fixed July 27 for the final disposal of the case.
On April 15, the High Court of Manipur declared Erabot as the elected MLA of Wangkhei assembly constituency after announcing the election result of Okram Henry as null and void.
Following the high court judgment, Erabot was sworn in as the MLA of Wangkhei assembly constituency on April 21.
