MHRC takes cognisance of pending cases at Porompat Police Station

The Manipur Human Rights Commission (MHRC) issued notices to SP Imphal East to submit the latest status report considering the reasons for delay of the investigation of the FIR cases relating to murder of the person/persons.

The Manipur Human Rights Commission (MHRC) on Tuesdy took suo-moto cognisance of the cases of rape, murder and others which are pending at Porompat Police Station.

The Commission issued notices to SP Imphal East to submit the latest status report considering the reasons for delay of the investigation of the FIR cases relating to murder of the person/persons. The OC of Porompat Police Station was also notified to appear along with the case diary for the list, and a brief status report regarding the names of the investigating officers of the FIR cases.

MHRC stated that it made a surprise visit to the Porompat Police Station, Imphal East as well as City Police Station, Imphal West and found near about 13 cases relating to offence of rape and 24 cases relating to the offence of murder which were pending for investigation. Other pending cases were also found at Porompat Police Station, it mentioned.

It is not clear why the investigation of a case lodged by a citizen for murder or rape in the year 2000 is still pending and for whose fault, MHRC stated.

“A speedy investigation is necessary to secure a just and proper outcome in a trial and instil and maintain confidence in the administration of criminal justice in our country. A speedy investigation also serves a preventive function. Those who witness the swiftness and accuracy, with which the criminal justice system punishes the perpetrator, will be deterred from committing similar crimes. An expeditious investigation and trial ensures that the trauma of victims/survivors is not prolonged,” the commission stated.

MHRC asserted that every citizen has the right to get justice as per preamble of the Constitution. Even the Apex Court also in some cases held that delay of investigation clearly violates the constitutional right, which also guarantees investigation and trial as insisted under Article 21 of the Constitution of India, it mentioned.  

Due to the delay of the investigation, both the family of the victim and the accused person are denied the fair trial as well as the justice. It is also settled by this time that the delay of investigation is nothing but the denial of justice which a citizen is entitled from the political government and its administrative authority including Police Administration, it added.
