Manipur High Court on Thursday rejected the application of MLA Karam Shyam and ordered for the procedure of an Election Petition for reaching a final decision to ascertain as to whether the election of Karam Shyam is void or not.
A single bench of the high court, the chief justice passed the order in regard to an election petition challenging the petition filed by veteran politician O Joy.
The petition filed by Joy, challenged on the ground that Karam Shyam Singh has made a false statement in the Form 26- Affidavit submitted along with the nomination paper so far as his educational qualification is concerned.
In the case, it is pleaded that Karam Shyam had passed Bachelor’s degree in Textile Technology, however, in the Form-26 Affidavit submitted along with his nomination paper, he stated that he has passed Bachelor’s degree in Textile Engineering. Such false declaration amounts to betraying the Electorate of 20-Langthabal AC, the petition stated.
Countering the Election Affidavit, Karam Shyam has filed an application being MC (El. Pet.) No. 9 of 2022 for rejecting the Election Petition No. 7 of 2022 (filed by O Joy) on the grounds that the said Election Petition has failed to disclose the actual cause of action while filing the same.
Following the high court’s proceeding, the order to reject the application of Karam Shyam was passed.
