Man gets life imprisonment for rape, murder of minor

The court observed that the convict of a 2014 rape case should be sentenced to rigorous imprisonment for a period of 20 years under section 6 POCSO Act, 2012 and also sentenced to life imprisonment under section 302 IPC.

Special Judge, Fast Track Court No 1, Manipur on Monday sentenced a man to life imprisonment under section 302 IPC for rape and murder of minor girl in 2014.

The convict Chingangbam Samjai, 20, son of (L) Ch Ingocha Singh of Tharoijam Maning Leikai, Imphal West was the prime accused in the rape and murder case of a minor girl from Imphal West.

Samjai has been convicted under section 6 POCSO Act 2012 and under section 302 IPC for the crime.

The Sessions Court, Manipur East under FIR number 42 (11) 2014 under Section 376/302 IPC and 4 POCSO Act 2014 and corresponding FIR 90 (11) 2014 Patsoi Police station under Section 376/302/34 IPC and 4 POCSO Act 2012.

During the sentence hearing, the counsel of the accused submitted that the accused was a young man aged 20 years at the time of occurrence of the crime, and a simple villager who worked as a labourer from time to time with no permanent employment. He prayed that considering the young age and being a simple villager from poor family background, mercy and leniency may be given to the accused.

However, the special public prosecutor submitted that the crime committed by the accused was rape and murder of an innocent minor girl of only eight years which shocked the conscience of every member of the community. Therefore, it was submitted that an exemplary punishment be given to arouse the indignation of the community against such crimes.

“The manner of the offender was extremely brutal, inhuman, vicious and pitiless. The injuries were multiple ranging across the vital parts of the body of the minor victim,” the court stated.

The court observed that as per the offence committed, he should be sentenced to rigorous imprisonment for a period of 20 years under section 6 POCSO Act, 2012 and also sentenced to life imprisonment under section 302 IPC.

As the offender had undergone custody from November 19, 2014 till May 30, 2022, the period of 20 years is to be set off, the court observed and sentenced him to life imprisonment.
