HC admits election petition filed by Okram Henry against MLA Th Arunkumar

The petition was filed by former minister Okram Henry seeking a direction from the high court to declare the election of Arunkumar as a member of the 12th Manipur Legislative Assembly from Wangkhei constituency as void.

Manipur High Court has admitted the election petition against Wangkhei MLA Th Arunkumar for allegedly not disclosing his assets and furnishing false and misleading particulars in his election affidavit.

The petition is listed on April 18 for hearing.

The petition was filed by former minister Okram Henry seeking a direction from the high court to declare the election of Arunkumar as a member of the 12th Manipur Legislative Assembly from Wangkhei constituency as void and also to declare that the petitioner is duly elected in the 12th Manipur Legislative Election from Wangkhei constituency.

The petitioner claimed that the details of the bank account (Punjab and Sind Bank), details of the area of agricultural land, details of the investment and correct approximate current market value of non-agriculture land and residential building, and details of the business of Arunkumar were not disclosed in his election affidavit.

It further mentioned that the details of the correct value of the residential building in Delhi, details of the loan account and liability, and details of the business of Arunkumar’s spouse were also not disclosed in the affidavit.

Both Arunkumar and his spouse did not disclose the details of various taxes and also the details of the PAN number of their dependents, the petition said adding the details of the contract entered with a private company (local TV channel), details of Arunkumar owned firms (M.B. Medical Store, M/S Arun Enterprises, Core Grow & Co and B.M. Bakery) was also not disclosed.

“During the scrutiny of the Arunkumar’s election affidavit, the RO of Wangkhei AC abruptly and improperly accepted the nomination paper. There was no proper scrutiny as envisaged under Section 36(2) of the Representation of the People Act, 1951,” it mentioned.

The affidavit also prayed to hold the trial of the petition on a day-to-day basis for disposal as early as possible and also to set aside the result of the election of Wangkhei AC of the 12th Manipur Legislative Assembly in respect of Arunkumar.

Arunkumar in the 12th Assembly Election of Wangkhei AC defeated former minister O Henry with a margin of 753 votes and former MLA Erabot with a margin of 2,318 votes.
