A 36-year-old father has been sentenced to 35 years of rigorous imprisonment by the special judge POCSO, Churachandpur on Thursday for assaulting and raping his 13-year-old daughter in Churachandpur district in 2020.
The convicted father was arrested following a complaint lodged by the victim's mother (ex-wife of the convict) who stated that the convict had assaulted and raped their daughter on the night of December 22, 2020 around 11.30 pm at the rented home of his brother in Churachandpur district.
During the hearing, the prosecution examined five witnesses, including the victim and the complainant and exhibited 21 documents and produced five material objects.
During the examination of the father's statement, the father did not adduce any evidence from any defence witness nor exhibited any documents in his defence. However, the father denied the charges levelled against him and also the evidence tendered by the prosecution witnesses for sexual assault against his daughter though he admitted beating the victim.
The court also imposed a fine of Rs 10,000 on the convict and stated that in default of the fine the convict shall undergo another term of simple imprisonment for two years. However, the court deducted the term that the convict has already spent in custody, from the sentence awarded (from December 5, 2020 till December 29, 2022).
The court further awarded a compensation of Rs 10 lakh from the state from the fund made available for the same which will be provided by the District Legal Services Authority, Churachandpur.
