Fake Encounter: 2009 BT Road firing incident defence argument begins

The infamous BT road firing incident of July 23, 2009 case defence argument has begun before the Session Court, Imphal East.

In connection with the July 23, 2009 BT Road (Khwairamband Keithel) firing incident, the Central Bureau of Investigation (CBI) submitted the charge sheet against the City OC, Y Munal and eight other police personnel viz. Hijam Devendro, Thounajam Herojit, Ngangom Toyaima, Wahengbam Binoykumar, Thokchom Jagat, Md Imran Khan, Oinam Keshor and Makan Kanchup Chothi in 2015.

Meanwhile, the case record of the trial was received by Session Court, Imphal East after it was transferred from Session Court Imphal West following an order from the High Court of Manipur.

After the charge was framed against the accused, based on the charge sheet submitted by the CBI, the trial began before the Session Judge, Imphal East on November 23, 2015.

It may be noted that the high-profile case was handed over to CBI by the state government after the Tehelka magazine published photos of the firing incident and the CBI, after investigation, submitted a chargesheet against Y Munal, the then Officer-in-Charge of City Police Station and eight other police personnel of Imphal West district.

In the charge sheet of the CBI, it was stated that the accused, viz H Devendro, Herojit, N Toyaima, W Binoy, Th Jagat, Md Imran, O Keshor and Makan Kanchung, with their common intention to cause death of Sanjit Meitei, accosted him and led him to the store room of Social Time Emporium (Maimu Pharmacy) under the command of the then inspector, H Devendra, where Sanjit, who was unarmed, was shot dead by Herojit.

Further, in pursuance of the common intention, Y Munal, H Devendra, Herojit and N Toyaima prepared false and incorrect records to save or knowing it to be likely that thereby they will save all accused from legal punishment for committing the murder of Sanjit Meitei.

Also, H Devndra and Herojit gave false information to City PS while lodging a complaint on July 23, 2009.
