The Chief Judicial Magistrate, Imphal West discharged Thangmeiband Assemby constituency MLA Kh Joykisan and his supporters in connection with a case registered against them in 2016.
The court accepted the final report of the case after the Investigating Officer (IO) could not make any progress in the case.
As the case has been kept long-pending without any progress, the IO returned the case on the ground that “the case is true but no clue against him”.
The court accepted the final report with an opinion that lapses of time etc and as it also appears that the IO investigated the case to make further progress and seen to be helpless and the court found no ground to reject the final report. Therefore, Joykisan and his supporters were discharged from all liabilities of the case, said the court order.
The brief of the case is that on January 16, 2016, the FIR was registered at City Police Station under section 147/149/511/427/34 IPC and 3PDPP Act, 1984 that Kh Joykisan along with his escort and supporters suddenly arrived at Thangal bazar between Kasturi crossing and two Ima Keithel Mouth where construction of Temporary market shed of Keithel No. 2 and 3 displaced vendors following the earthquake incident occurred on January 4, 2016.
Kh Joykisan and his party started dismantling the construction materials like fencing wall CI sheets, planks, pillars, bricks, etc in a sudden provocation without any prior information to the concerned authorities. The act done by him tantamount to punishable under the law. Hence the case was registered against him.
