Child Molestation Case: Special Judge (POCSO), Imphal West prays to transfer bail applications to competent court

The three accused persons, namely Meitan Keishangbam Manikanta, Salam Iboyaima Meitei and Saikhom Mandakini Chanu filed anticipatory bails in apprehension of arrest in connection with the molestation case of a differently-abled minor girl.

Special Judge (POCSO), Imphal West on Saturday observed that it will not be proper for the court to pass any order on merit in connection with the three anticipatory bails of three persons, and further prayed to transfer the applications to another court of competent jurisdiction.

The three accused persons, namely Meitan Keishangbam Manikanta, Salam Iboyaima Meitei and Saikhom Mandakini Chanu filed anticipatory bails in apprehension of arrest in connection with the molestation case of a differently-abled minor girl.

Meanwhile, the victim’s mother lodged a complaint before the High Court of Manipur, Chief Justice to inquire into the circumstances under which the three accused persons have been granted interim anticipatory bail by Special Judge (POCSO), Imphal West, and the complaint is pending before the High Court.

Therefore, the Special Court (POCSO), Imphal West in the interest of justice and fairness, prayed to transfer the application to another competent jurisdiction court.

The court asked to send an order copy to the Registrar General of the High Court of Manipur with a request for placing the matter before the Chief Justice for examination and consideration.

Further, the Special Court (POCSO), Imphal West also dismissed the bail application for the accused Nameirakpam Inaomacha Meitei who is in judicial custody in connection to the case, without passing any order on merit. The court has advised the accused to approach the appropriate forum.

It may be mentioned that the minor victim’s mother lodged a complaint against the Special Judge (POCSO), Imphal West before the Chief Justice, High Court of Manipur over the matter of granting anticipatory bail to three accused. The three accused allegedly kidnapped her minor and had her confined with them overnight during which she was sexually molested.
