Process appointment of Manipuri language officers based on outcome of pending petition: HC to Assembly

On the notification issued on January 14, the Manipur Legislative Assembly appears to have initiated the process of recruitment and written examination appears to have been conducted.

A single bench of the High Court of Manipur justice Kh Nobin on Wednesday directed Manipur Legislative Assembly to process the appointment six posts of assistant Manipuri (Meetei Mayek) Language officer based on the outcome of a petition pending in the court.Secretariat

The directive of the HC came following the petition filed by two petitioners in connection with appointment of six assistant Manipuri (Meetei Mayek) Language officers. The court has also issued notice to Manipur Legislative Assembly returnable by April 29.

The grievances of the petitioners are that out of six vacancies, one is reserved for ST and the rest are unreserved but no seat has been reserved for persons belonging to OBC category.

On the notification issued on January 14, the Manipur Legislative Assembly appears to have initiated the process of recruitment and written examination appears to have been conducted. Again, the joint secretary (admin), Manipur Legislative Assembly issued another notification on March 27, 2021, enumerating the number of persons who are qualified for interview, informing that interview or viva voce will be held on April 9, 2021.

The petitioners stated that no post is reserved for OBC candidates in the impugned notification of January, 14, 2021. It stated that the act was a prima facie case of illegal, arbitrary, mala fide, extraneous consideration, colourable exercise of power, preferential treatment, full of bias, favouritism, nepotism, against the Manipur Reservation of Vacancies in Posts and Services (for Scheduled Castes and Scheduled Tribes) Rules, 2011, “ultra vires” the provisions under Articles 14 & 16 of the Constitution of India and bad in law.

There is no specification in the number of successful candidates categorically as Un-Reserved, Schedule Tribe, Schedule Caste & Other Backward Classes (OBCs) etc. in the result of the written test examination of March 27, 2021, the petitioners’ stated.

It also stated that there are no proper Recruitment Rules for the post of Assistant Manipuri (MM) Language Officer in Manipur Legislative Assembly Secretariat.
