Makhan Killing Case: High Court notice to Manipur government, NHRC

The Manipur government and the National Human Rights Commission have been directed to respond within four week's time in connection with the killing of two people at Makhan village in 2009.

The Manipur High Court has issued notice to the Manipur government and the National Human Rights Commission (NHRC) following a writ petition filed by Suhas Chakma, a Delhi-based Human Rights activist, in connection with the killing of two individuals at Makhan village in 2009.

In the petition, Chakma urged the Manipur High Court to issue directions to the chief secretary, Manipur to comply with the NHRC order.

Chakma filed a complaint to the NHRC in connection with the killing of two individuals identified as Ningthoujam Anand Singh and Palungbam Kunjabihari at Makhan village on January 21, 2009.

It may be noted that the two were killed by a combined force of Manipur Police Commandos and 16th Assam Rifles in an alleged encounter.

During the course of hearing of the case, the NHRC rejected the contention of the Manipur government wherein it was claimed that the encounter was genuine.

In a letter sent to the chief secretary, Manipur on September 21, 2020, the NHRC said that the Manipur government to pay an amount of Rs 5 lakh each as monetary compensation to the next of kin of the two deceased persons and submit compliance report along with proof payment. However, NHRC reportedly closed the case without seeking a compliance report from the Manipur government.

Earlier, the petitioner, Chakma, approached the Delhi High Court by way of writ petition (WP No. (c) 1939/2021) to direct the NHRC to take coercive measures to implement its order.

However, the Delhi High Court, in its order passed on September 20, 2022, informed the petitioner, Suhas Chakma, to approach the jurisdictional High Court for enforcement of orders that may have been passed by the NHRC.

The Manipur High Court, in its order passed on December 15, 2022, called responses from the Manipur government and NHRC in four weeks' time.
