Central Bureau of Investigation (CBI) has submitted the closure report of an alleged fake encounter incident involving troops of 28 AR before Chief Judicial Magistrate, Imphal East citing insufficient evidence.
The alleged encounter took place ten years ago at Andro Sanapat area in the intervening night of October 31 and November 1, 2009 where seven youths were allegedly killed. The victims are Oinam Anand Meitei, son of O Yaima Meitei of Ashikha Mayai Leikai, Oinam Pakpak alias Maipaksana, son of O Bhimo of Ashikha Mayai Leikai, Laishram Boicha, son of L Kumar of Seijang Awang Leikai, Chingangbam Gogo, son of (L) Ch Tomba of Leitong Khulen Awang Leikai and Sinam Ratankumar Meitei, son of S Thambaljao and Thangpao Kipgen. However, one of the slain victims has not been identified yet.
The body of Thangpao Kipgen and another unidentified body were earlier disposed by Imphal Municipal Council.
The case was filed by EEVFAM and Human Right Alert before the Supreme Court under writ petition no- 129 of 2012. The petition was prayed to reinvestigate the fake encounter cases 1528. The Supreme Court took up criminal petition and directed CBI to form SIT to reinvestigate the cases, among the cases killing of seven youth was also include.
Under Supreme Court direction CBI has registered three different cases. Those cases are RC-18(S)/2017/SC-3/New Delhi, under section 307/34 IPC, 25(1-C)Arms Act, 3-Explosive Substances Act, 6 (1-A)IWUT Act and 20UA(P) Amendment Act, 2004, RC-19(S)/2017/SC-3/New Delhi under section-365/368/447/34 IPC and 25(1-C)Arms Act and RC-DCT/2018/S/0006 under section-364302/34 IPC. The three cases were registered on December 7, 2017 and February 24, 2018.
Investigation officers of the three cases are PK Roy, VPS Maan(DSP) and HP Meena(DSP) of CBI, New Delhi.
After CBI took up the case and started investigation, Thangpao Kipgen son of (L)Lukhokoi Kipgen of Nongmaiband village was later identified. Thangpao Kipgen body was disposed by IMC, as no one claimed the body at that time.
It may be mentioned that among seven youths who were alleged killed in the fake encounter by troops of 28 Assam Rifles, two youth namely Oinam Anand and Oinam Maipaksana were arrested before the incident by suspected underground militants on intervening night of October 22 and 23, 2009 from their residences. It was reported by the mother of two at Heingang Police Station.
Further, mothers of the duo namely Oinam Ongbi Yaimabi Leima and Keinatombi Leima filed a petition before the High Court of Manipur under criminal petitions on 2010.
The High Court of Manipur took up the petition and directed district judge, Manipur East for enquiry. After submission of enquiry report, the court ordered Assam Rifles to pay a compensation of Rs 5 lakh to each family on December 7, 2018.
Also among the remaining five deceased victims, Thangpao Kipgen was reported to have arrested on October 27, 2009 from Leimakhong area. It was reported as per the FIR under Saparmeina Police Station.
