Court rejects police’s custodial remand plea of six officials of revenue department

The officials have been granted interim anticipatory bail by the additional Session Judge (Fast Track Court), Manipur East till March 8.

The Chief Judicial Magistrate (CJM) Imphal West on Saturday rejected police prayer seeking custodial remand of six officials of revenue department, who were charged with forgery.

It is learned that the officials have been granted interim anticipatory bail by the additional Session Judge (Fast Track Court), Manipur East till March 8.

The CJM in an on order stated “it finds no reason to remand the six officials into police custody in the case as the fact of the case is the same and all the officials are the same as that of the case under section 420/468/34 IPC as interim anticipatory bail has been granted till March 8, 2021 by the additional Session Judge (Fast Track Court), Manipur East”.

The six officials have been identified as Tonjam Hemjit Singh, 53, son of (L) T Birendra of Keishampat Kangabam Leikai; Thingnam Biben Singh, 57, son of (L) Th Girani of Thangmeiband Kabrabam Leikai; Okram Munal Singh, 61, son of (L) O Chaoba Singh of Thoubal Kiyam Siphai; Samom Bishwajeet Singh, 57, son of (L) S Krishnachand Singh of Yaiskul Janmasthan; Khundongbam Mohendro Singh, 57, son of (L) Kh Mani Singh of Heirok Part-II and Grison Wairokpam, 29, son of W Kumar of Chingamakha Maisnam Leikai.

The Lampel police station registered a case after substantial manipulation was reported in the revenue department which falls under Lamphel police station, without proper authorisation thereby violating the office norms and rules. The manipulation was done between May 29, 2018 to December 29, 2020.

The police stated that on examination, it was found out that the six officials together conspired and manipulated the documents without authorisation from the competent authority. Stating that they have admitted to the charges leveled against them, it pleaded for custodial remand.

To this, the court said, “If the interim anticipatory bail is made absolute by the Additional Session Judge (Fast Track Court), Manipur East, the present interim bail will also be extended automatically. However, if the interim bail is cancelled by the additional session judge, the police are given liberty to arrest the accused person, if so desire”.
