Fake Encounter Case in Manipur: Court summons eight policemen

The Central Bureau of Investigation (CBI) had submitted the charge sheet against the eight police personnel on December 29, 2020, under section 302/323/506 and 201 read with 34 IPC.

The court of Chief Judicial Magistrate, Imphal West on Friday summoned eight Manipur police personnel in an alleged fake encounter case in which 12–year-old Md Azad Khan of Phoubakchao Makha Leikai was killed in 2009.

Taking cognizance against the eight accused, the court issued summons to one Havildar Bronson Thanga Chiru; rifleman Ksh Rama Singh; rifleman Ksh Rama Singh; Havildar Sh Phuritsabam Suresh Meetei; rifleman, Sh Thangjapao Touthang; rifleman Sh K Rabichandra Singh; rifleman Ng Tronil James; rifleman Sh M Budhichandra Singh for appearance before the court on March 17 for further proceeding.

It may be mentioned that three Assam Rifles jawans namely Vijay Singh Balhara, the then Major, 21 Assam Rifles; Gopal Singh, the then rifleman/cook, 21 Assam Rifles; Md Riyakat Ali, the then rifleman/cook, 21 Assam Rifles are liable for prosecution for the commission of offenses under section 302/323/506 and 201 read with 34 IPC.

The prosecution sanction under 197 CrPC as well as under section 6 of AFSPA for prosecution against Vijay Singh, Gopal Singh, and Md Riyakat Ali is still awaited from the competent authority. In the charge sheet, the CBI stated that it would be submitting a supplementary charge sheet after receiving sanction from the competent authority.
