Court directs Thoubal OC to register case in alleged rape of minor

The victim in her complaint stated that she was 14-year-old when she was allegedly raped by Md Sabir Ahamed by threatening her with dire consequences.

The Court of Special Judge (POCSO), Thoubal A Noutuneshwari Devi on Wednesday directed the officer-in-charge of Thoubal police station to register a criminal case in connection with an alleged rape case of a minor.

The OC was directed to register the case as per an application under section 33 (1) of Protection of Children from sexual offence Act, 2012 read with 156 CrPC.

A minor victim from Thoubal district had filed the application on January 18 under POCSO Act, 2012,  praying to take cognisance of the offence allegedly committed by one Md Sabir Ahamed, 25, son of Md Nazir Ali of Kiyamgei Awang Leikai, Imphal East or direct the officer-in-charge, Thoubal Police Station to register a criminal case for the offence and to punish him according to law.

The victim in her complaint stated that she was 14-year-old when she was allegedly raped by Md Sabir Ahamed by threatening her with dire consequences. She disclosed the incident when she became pregnant and found out by her parents. As per the complaint, her parents lodged a complaint at Thoubal Police Station but instead of registering a criminal case against the accused Person. But the victim was made to marry the accused person inside the police station on September 30, 2017 by solemnising a Nika under a local Maulvi, it stated.

The complaint mentioned that after getting married, the victim was taken to the accused person’s home where she was abused and mistreated by the accused and his parents.

When her son turned six-month-old, she went back to her parental house after staying at a relative’s place for some time. The accused took her back to his home along with her son when the baby turned three.  Again, the victim was ill treated and harassed by the accused and even attempted to kill her, the complaint stated while adding she returned back to her parental house with the help of her relatives.

It stated that while staying at her parental house, the accused came and demanded to conduct a DNA test of her son to find out if he was the father.   

The victim filed the application before the court with prayer of taking cognisance and to direct the officer-in-charge Thoubal Police Station to register a criminal case.

The court heard the application from the submission of the counsel and directed the OC of Women Police Station Thoubal to investigate the matter and submit the report.
