2018 case: HC directs SP Churachandpur to form SDT to secure absconding convict Timothy

The Special judge POCSO Imphal West Maibam Manojkumar had convicted Timothy L Changsang, administrator of North Eastern Children Home, Rengkai village Churachandpur, under section 6 and 10 of POCSO Act and under 506 IPC on April 30, 2019 and issued a non bailable warrant to arrest him.

The High Court of Manipur directed SP Churachandpur to form a special dedicated team (SDT) to secure the absconding convict Timothy Chansang, who was convicted for minor sexual offence in 2018.

A division of chief justice Ramalingam Sudhakar and justice Kh Nobin, High Court of Manipur issued the directive. The HC also directed IGP (intelligence), Manipur to monitor the issue on the steps taken by SP Churachandpur in securing the absconding convict.

The court has taken up a suo moto on the basis of a report that the accused in the instant crime was administrator of a children home namely North Eastern Children Home located at Bethlehem Veng, Churachandpur. He was convicted for the offences under provision of prevention of children from sexual offence act. However, when the conviction order was passed, the accused had already escaped the net and he is in large. Several detailed orders were passed on several dates asking state police and SP, Churachandpur to secure the convict.

During proceedings, advocate general N Kumarjit reported that the Home Department has written to the Bureau of Immigration (BOI), headquarter for extending the Look-Out circular. A Romenkumar, Amicus Curiae also suggested that the conviction order was passed on April 30, 2018 and the convict is still at lage and absconding from due process of law and in order to ensure further progress in the case, a special team should be formed which will be monitored and guided by the intelligence department which will ensure better co-ordination for security the absconding convict.

Subsequently, the HC considered the plea and passed the order for the formation SDT. While passing the order the HC also asked the ASG, S Suresh, who appeared for the Union of India, to pursue the matter in so far as the look-out notice is concerned and render all assistance to the state police.

It may be mentioned that according to submission from the public prosecutor, as an informal report from SP, Churachandpur the convict Timothy L Changson left Imphal for Guahati on March 28, 2018. While travelling his name was changed to Lambun Moya Changson.

The Special judge POCSO Imphal West Maibam Manojkumar had convicted Timothy L Changsang, administrator of North Eastern Children Home, Rengkai village Churachandpur, under section 6 and 10 of POCSO Act and under 506 IPC on April 30, 2019 and issued a non bailable warrant to arrest him.

Timothy was charged with raping 14 minor girls for over two years since 2012 at a children home run by him (convict). The incident came to light in February 2015 after a minor girl, inmate of the home, lodged a complaint with the police. However, on May 27, 2015 the convict was reportedly granted bail by a POCSO court.
