Manipur High Court urged to pronounce judgment in ADC Churachandpur case

The final hearing of the case was heard on September 7, 2020.

All Tribal Students’ Union Manipur (ATSUM) has urged the Manipur High Court to expedite disposal of the case reserved for judgment in respect of the Autonomous District Council, Churachandpur for a proper local self government in the interest of the tribal populace in the district.

A release issued by ATSUM information and publicity secretary Khaiminlen Doungel on Wednesday said the final hearing, which was made on September 7, 2020, is kept reserved for judgment. However, 15 days have passed and so far no judgment is being pronounced till date, he contended.

The release stated that ADCs are the sole local self-government entities in the hill areas of Manipur and proper functioning of the councils are of utmost importance for both political and economic development of the hill areas.

However, it is very unfortunate that the grass root local self-government that has to play a pivotal role especially during this time of COVID-19 in containing the pandemic, is in tussle for power and posts thereby making people suffer more miserably amidst the pandemic.

The release further said that a a no confidence motion was submitted for removal of the incumbent chairman, ADC Churachandpur to the deputy commissioner, Churachandpur as per provision of the District Council Act, 1971.

Subsequently, the deputy commissioner had issued a notification for consideration of no confidence motion in respect of ADC Churachandpur on August 17 this year vide order No. DC(CCP)/EST/2015-21(PT) and thus the meeting was conducted democratically on the next day at council hall, Churachandpur where ADC members participated and voted, the release said.

However, as one of the ADC members filed a writ petition case in the High Court of Manipur challenging the legality of the meeting, the High Court issued an order on September 18, 2020 directing not to proceed any further action with regard to the meeting proceedings, it said.

The union also appealed for immediate fast track hearing and judgement in case of ADC Senapati with similar issue and also urged the government and the judiciary to institute a fast track court or system to handle such sensitive political issues in future.
